Team Awareness Combating Overdose (TACO) General Privacy Policy

We at Team Awareness Combating Overdose (TACO) Inc., a California corporation (“TACO,” “we,” “us,” “our”), care about you (you,” “user,” “learner,” and/or "business professional" as appropriate) and how your personal information is used and shared.

This Policy applies to all TACO services and websites (collectively, the “Service”), and it describes how TACO collects, uses and discloses the information it collects via the Service. In some instances, our Service may be accessible via a third-party website, including that of an Authorized Entity (defined below). 

This Policy does not apply to how a third party or an Authorized Entity collects, uses, or discloses any information related to Service users.

1 | PERSONAL INFORMATION WE COLLECT

TACO’s digital learning platform offers educational courses on overdose prevention in the Higher Education market. We may collect information about you directly from you, an Authorized Entity with which you are associated, and automatically through your usage.

Information We Collect Directly from You. Where you register for an account with us, communicate with us, or request to use our Service, we may collect the following information:

  • Contact information and common identifiers: Such as name, IP address, phone number, and email address;

  • Login details: Including username and password;

  • Educational details: Including information about a user’s level of education and academic institution;

  • Job Details: Job title and which institution you work with;

  • Communications preferences.

  • Demographic information: Such as age, sex, race, ethnicity, and gender;

  • Preferences: Based on user-specific implementations and information about user activities within the Service, including information about the content modules a user views, starts or finishes (including data and time stamps), assessments or scores, and related information, and other information about a user’s activities and use of the Service in order to ensure our digital learning is appropriately teaching overdose prevention skills.

Information We Collect Automatically. We collect information automatically about users via a variety of methods, such as cookies, web beacons, JavaScript, and log files. This information may include user IP addresses, browser types, domain names, device type, time stamp, referring URL and other log file information, user activities within the Service, aggregate and statistical information regarding overall server/visitor traffic and navigation patterns for the Service. Web servers collect this type of basic information automatically as part of Web log processes. For more information, see the “How We Use Cookies and Analytics” section below.

Information Obtained from Third Parties/Public Sources. We use third party service providers to enhance and enrich our marketing database of business professionals who have requested further information on our products. They may use information that is made public by you.

2 | HOW WE USE PERSONAL INFORMATION

TACO generally uses the information we collect as follows:

  • To provide you with our Service, which includes:

    • maintaining and servicing accounts;

    • verifying your information;

    • providing customer services, such as communicating with you about your use of the Service (including via email);

    • processing payments;

    • responding to your inquiries;

    • sending you surveys; 

    • providing advertising or marketing services to you;

    • fulfilling your requests; and,

    • for other customer service or internal purposes.

  • To troubleshoot any technical issues you might experience while using our Service.

  • Where you are a business professional (e.g. sponsoring organization such as a university or other higher education institution), to send you communications about digital courses, services and other information we think may interest you where you have requested information about our products or services and otherwise where we have any necessary permissions. We may also enrich our marketing database using publicly available information to tailor our communications and ensure these are relevant to your industry and of interest to you.

  • To better understand how users access and use our Service, in order to improve our Service, to respond to user desires and preferences, and for other research and analytical purposes.

  • To develop aggregated reports and related analysis regarding user activities.

  • To tailor the educational content and information that we may send or display to you, to offer personalized help and instructions, and to otherwise personalize your learning experience while using our Service.

  • To comply with applicable legal obligations, including responding to a subpoena or court order.

  • Where we believe it is necessary to investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person or violations of our Terms of Use or this Policy.

Marketing. We may use your information to contact you with newsletters, marketing or promotional materials and other information that may be of interest to you. You may opt out of receiving any, or all, of these communications from us by following the unsubscribe instructions provided in any email we send, or you can contact us using the contact details provided in the “How To Contact Us” section below. You will still continue to receive service-related messages concerning products and services you have purchased or for which you have registered (unless we have indicated otherwise).

3 | SHARING OF PERSONAL INFORMATION WITH THIRD PARTIES

To Users or the Public with Your Consent. We may share your information with other users or the public with your consent.

Affiliates and Service Providers. We share your information with our affiliates and third-party service providers, and any subcontractors, as required to offer you our Service. These parties help us to:

  • Run, operate, and maintain our Service through third-party platforms and software tools;

  • Perform content moderation and crash analytics;

  • Run email messaging campaigns; 

  • Perform marketing analytics;

  • Provide measurement services and targeted ads (you can opt out of these services at websites such as http://www.aboutads.info/choices and http://www.youronlinechoices.eu/);

  • Administer surveys;

  • Provide payment attribution; and,

  • Provide technical and customer support.

Authorized Entities. If you access the Service through, or are granted access to the Service by, a school, school district, college, university, person, institution, employer, or other organization (an “Authorized Entity”), we will share the information we collect about you with the Authorized Entity or its representatives.

Third-Party Sponsors. In the Higher Education market, TACO works with third-party sponsors to bring the Service to some users free-of-charge.

Legal Disclosures. We may be required to disclose your data in response to lawful requests by public authorities, including to meet law enforcement requirements. We may be under a duty to disclose or share your personal information to comply with any legal obligation, to enforce or apply our terms and conditions and other agreements, to protect our rights, property, or safety, or to protect the rights, property, or safety of others. This includes exchanging information with other companies and organizations for the purposes of fraud protection.

Aggregate and De-Identified Information. We may also provide aggregate, anonymous, or de-identified information about users and the Service for marketing, research, and other purposes.

4 | HOW WE USE COOKIES AND ANALYTICS

To make our websites and Service work properly, we sometimes place small data files called cookies on your device. A cookie is a small text file that a website saves on your computer or mobile device when you visit the site. It enables the website to remember your actions and preferences (such as login, shopping cart, or other preferences) over a period of time, so you do not have to keep re-entering them whenever you come back to the site or browse from one page to another. 

Third-Party Analytics. From time to time we may use various tools to evaluate usage of our Service. We may use Google Analytics. We do not combine the information collected through the use of Google Analytics with personally identifiable information. Please refer to Google’s Privacy Policy for more information. You may also choose to download the Google Analytics opt-out browser add-on.

You may wish to restrict the use of cookies. Please be aware that some of the features of our websites may not function correctly if you disable cookies. Most modern browsers allow you to change your cookie settings. You can usually find these settings in the options or preferences menu of your browser. To understand these settings, the following links for commonly used browsers may be helpful:

Personalized Advertising. We may also use targeted advertising cookies to deliver tailored advertising on our website and other websites that you may visit. You can learn more about how to control advertising cookies by visiting the Network Advertising Initiative’s Consumer Opt-Out link, the DAA’s Consumer Opt-Out link for browsers, or the DAA’s opt-out link for mobile devices. Please note that electing to opt-out will not stop advertising from appearing in your browser or applications and may make the ads you see less relevant to your interests.

5 | HOW WE RESPOND TO ‘DO NOT TRACK’ SIGNALS

Some browsers provide you with a way to signal that you do not want your browsing activity to be tracked. The Service may not currently respond to all Do Not Track (“DNT”) or similar signals, as we are awaiting consensus from the Internet policy and legal community on the meaning of DNT and the best way to respond to these signals.

6 | HOW WE PROTECT & RETAIN PERSONAL INFORMATION

TACO implements reasonable and appropriate physical, administrative and technical safeguards to help us protect your personal information from unauthorized access, use and disclosure, and to maintain accuracy and ensure the appropriate use of your information. However, no data transmissions over the Internet can be guaranteed to be 100% secure. Consequently, we cannot ensure or warrant the security of any information you transmit to us and you do so at your own risk.

We retain information from or about you for so long as necessary to fulfill the purposes outlined in this Policy. When the information is no longer necessary for these purposes, we delete it or keep it in a form that does not identify you, unless we are required by law to keep this information for a longer period.

7 | PRIVACY RIGHTS

Request to Remove or Update Data. If you or your legal guardian (for users under the age of 18) want to request the deletion of your data, you or your guardian (after providing reasonable proof of guardianship)  can send us an email to request that we remove it by contacting us at contact@tacoinc.org. If you would like to amend your profile information, you may log in to your account and do so or email us at contact@tacoinc.org. You should understand that in some cases, we may retain copies of such information in our systems or databases where required or permitted by law.

Request to Opt-Out of Emails. Where we have permission, we may send periodic marketing emails to you. You may opt-out of such communications by following the opt-out instructions contained in the email or by contacting us at contact@tacoinc.org.  Please note that it may take up to 10 business days for us to process opt-out requests. If you opt-out of receiving emails about recommendations or other content we think may interest you, we will still send you service emails about your TACO account or any services you have requested or received from us.

Third Party Marketing. If you are one of our customers, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal information to third parties for the third parties’ direct marketing purposes. We do not disclose your personal information to third parties for the third parties’ direct marketing purposes.

8 | CHILDREN’S PRIVACY

Our Service is not directed at individuals under the age of 13. We do not knowingly collect personal information from children under 13. If you become aware that a child has provided us with personal information, please contact us using the contact details provided at the end of this Policy. If we become aware that a child under 13 has provided us with personal information, we will take steps to delete such information.

9 | CHANGE OF CONTROL

We reserve the right to transfer information (including personal information) to a third party in the event of a sale, merger or other transfer of all or substantially all of the assets of TACO or any of its affiliates (including as part of a bankruptcy proceeding).

10 | CHANGES TO OUR PRIVACY POLICY

TACO may amend this Privacy Policy from time to time. We will provide notice of any material changes made to our Privacy Policy by prominently posting the revised Policy with an updated date of revision on our homepage. We encourage you to check this page periodically for any changes. If we make any material changes that affect information we have previously collected about you, we will provide you with notice (or in the case of a child, to your parent or legal guardian - or to your school/educational institution who will make it available to you or your parent or legal guardian), via email or within the Service.
